A judge must decide what is just and right in a property and debt division. See Texas Family Code 7.001. In making this decision for pet ownership, a judge may consider which spouse found or picked out the animal, who cared for the animal daily, and who made veterinary choices for the pet.
In California courts, pets are not children. Section 2605 defines a pet animal as, any animal that is community property and kept as a household pet. Essentially, pets are still property, but they are subject to special considerations in court.
Section 137 Registration and licensing of dogs (a) The owner or keeper of a dog over the age of 6 months shall obtain a license for the dog. The registering, numbering, describing and licensing of a dog shall be conducted in the office of the licensing authority in the city or town in which the dog is kept.
So remember, in the event of a simple breakup, where neither party is married, but they have shared a dog, the person who bought the dog, the person who can prove that the dog is their property, is the one who usually gets to keep that possession or the dog.
If one person owned the dog before the marriage, that person will probably keep ownership of the animal. If one spouse received the dog as a gift, he or she will probably be able to keep it.
In general, although there are some exceptions, you would not take legal action until or unless your ex physically takes the pet from you without your permission. In this case, you would have to sue your ex for the pet under a property-recovery legal theory, such as replevin.
While we may consider them family members, in a divorce a pet is considered property. This property, e.g., Fido, is usually awarded to one spouse, although this is changing with some judges now awarding shared custody of pets.
Pets are considered community property As Texas is a community property state, pets are treated as assets. During a divorce, the judge will value the pet and decide which spouse will keep them.
As property, the dog is subject to distribution as property. Thus, if the dog belonged to one of the spouses before the marriage, it will likely remain that persons property after the divorce. However, if the dog was purchased after the marriage, it will be considered a marital asset.
