New Law: The new law maintains a 45-day notice requirement. However, a docHub change applies state wide. In the state of Maine, if a landlord plans to raise a tenants rent by 10% or more, they must now provide at least 75 days written notice.
Rent Increases: There is no legal limit to the amount of rent a landlord can charge. However, in order for the rent increase to be valid, the landlord must provide the tenant proper notice of the raise in rent and the tenant must agree to it (signs the lease with the new monthly rent).
In a tenancy-at-will the tenant pays the agreed-upon rent each month for an indefinite period of time. Either the landlord or the tenant can decide to end the tenancy by giving the other party notice either 30 days or one month before the due date of the next rent payment, whichever is longer.
Rent and Late Fees Grace period: There is a rental grace period of 30 days (MGL c. 186 15B(1)(c)). Late fees: Charging a late fee is allowed, but not required (MGL c. 186 15B(1)(c)).
State law requires that tenants must be given a required notice period prior to a rent increase. For a year-long lease, the notice must be provided 30 days before the end of the lease term. If its a month-to-month lease, landlords must also respect a 30-day notice period before the rent increase takes effect.
NOTICE OF RENT INCREASE As indicated in your lease, your lease at [PROPERTY ADDRESS] will end on [LEASE EXPIRATION DATE write in full]. Please note that the monthly rent for the above [PROPERTY ADDRESS] will increase from [OLD RENT AMOUNT] to [NEW RENT AMOUNT] effective [DATE OF NEW LEASE write in full].
