The eviction process in Ontario is complex but it can be broken down into the following 6 steps. Step 1: Reason for Eviction. Step 2: Give Tenant Written Notice. Step 3: File Application with the Landlord Tenant Board. Step 4: Attend the Hearing. Step 5: Eviction Order. Step 6: Enforcing the Eviction Order.
If the landlord wants to serve notice on the same day, then the tenancy agreement should be signed first. Although there is no prescribed format for a s21 notice, it must be served in writing and certain information must be given. Other forms of communication such as e-mail or telephone are not valid.
A landlord may end a tenancy if one or more of the following applies: Disturbances and safety concerns. Failure to repair damage. Government orders. Illegal activities. Non-compliance with directors orders. Non-payment of deposits. Occupancy violations. Property damage.
If you get a section 21 notice, its the first step your landlord has to take to make you leave your home. You wont have to leave your home straight away. If your section 21 notice is valid, your landlord will need to go to court to evict you. You might be able to challenge your eviction and stay longer in your home.
Your notice must be in writing, so avoid email, text messaging, and social media. Instead, give your landlord a signed and dated letter with your name, signature, address, and move-out date, as set out in section 52 of the RTA. See TRACs template letter, Notice to Move Out.
What is a Section 8 Notice? Unlike a section 21, a section 8 eviction notice can only be served if the tenant has: BdocHubed the tenancy agreement. Been in rent arrears for over two months. Used your property to perform criminal activity.
The Notice to Quit must include the name of the landlord, tenant, address of the rental property, reason for the notice, date by which to vacate, explanation for why, if applicable, information about the move-out procedure, and contact information for any questions.
