Rule 611(c) of the Federal Rules of Evidence, lists the situations in which leading questions are appropriate, which include on cross-examination, when dealing with preliminary matters, when there is difficulty eliciting testimony from a witness, and when a hostile or adverse witness is being questioned.
Need for Personal Knowledge. A witness may testify to a matter only if evidence is introduced sufficient to support a finding that the witness has personal knowledge of the matter. Evidence to prove personal knowledge may consist of the witnesss own testimony.
These five hearsay exceptions are (1) former testimony; (2) dying declarations; (3) statements against interest; (4) a declarants statements regarding that individuals own family history; and (5) a declarants statements against a party who caused the declarants unavailability. See Fed. R.
It limits cross-examination to credibility and to matters testified to on direct examination, unless the judge permits more, in which event the cross-examiner must proceed as if on direct examination. This traditional rule facilitates orderly presentation by each party at trial.
Rule 602 provides that witnesses lack of personal knowledge excludes them from testifying except when expert witnesses are involved or in other circumstances. Rule 603 requires that witnesses give an oath or affirmation that they will testify truthfully.
Lack of personal knowledge. A witness may not testify to a matter unless evidence is introduced sufficient to support a finding that he has personal knowledge of the matter. Evidence to prove personal knowledge may, but need not, consist of the testimony of the witness himself.
Under the best evidence rule, the original of a writing, recording, or photograph is generally required in order to prove the contents of that item.
Understanding the Business Records Exception to the Hearsay Rule A Record, Act, Condition or Event. Made in the Regular Course of a Business. The Writing Was Made At or Near the Time of the Act, Condition, or Event. The Custodian or Other Qualified Witness Testifies to its Identity and the Mode of its Preparation.
Rule 601 deals with competency of witnesses. Both the House and Senate bills provide that federal competency law applies in criminal cases.
Rule 601. General rule of competency; disqualification of witness. (a) General rule. Every person is competent to be a witness except as otherwise provided in these rules.
