Some things are not protected by copyright. For example, copyright does not protect factual information or data, titles, short word combinations, names, characters, slogans, themes, plots, or ideas.
When to enforce your copyright. All actions for infringement must generally be brought within 3 years from the time someone ought to have known about the act of infringement. If someone has circumvented a technological protection measure such as a digital lock, this time limit is 2 years.
One of the conditions for copyright is that where the author of the work must have been, at the date of the making of the work, a citizen or subject of, or a person ordinarily resident in, Canada or a country with which Canada has certain treaty obligations.
These primarily deal with infringement that involves sale or rental of copyrighted materials, and can result in fines of up to $1,000,000 or prison sentences of up to 2 years for indictment. For a summary conviction, the maximum fine is $25,000 and prison term is limited to 6 months.
Canada passed its first colonial copyright statute in 1832 but was subject to imperial copyright law established by Britain until 1921. Current copyright law was established by the Copyright Act of Canada which was first passed in 1921 and substantially amended in 1988, 1997, and 2012.
Copyright does not last forever. In Canada, copyright generally lasts for the life of the author, plus 70 years (i.e., the life plus 70 rule).
Copyright infringement occurs when a person uses content protected by copyright in a way that violates rights granted in the Copyright Act, for example by copying or communicating to the public a copyrighted work (all or a substantial part of it) without authorization from the owner of the copyright.
Generally, copyright is the exclusive legal right to produce, reproduce, publish or perform an original artistic, literary, musical or dramatic work. To obtain a registered copyright in Canada, you must file an application with the Canadian Intellectual Property Office (CIPO).
