At the time of me writing this (July 2018), photographs are protected as artistic works in the same way that a painting or an illustration is. Generally speaking, the copyright belongs to the person who created the image in the case of a photograph the person who took it (i.e. the photographer.)
The law says you created that image as soon as the shutter is released. This means that photographer copyright laws state that whoever pushed the button owns the copyright. A photographer will own that copyright throughout their life and 70 years afterwards.
A photo licensing agreement is a legal contract where the owner of a photo licenses the use of the image to a person or company. The original owner gets to keep the images copyright. The contract stipulates the terms on how, when, and where the licensee can use a particular photograph.
This clause covers sexual, violent, or any other type of harassment that may happen or occur that causes you to be uncomfortable or feel unsafe. This will clearly explain what is and what is NOT acceptable, as well as what images you will be liable for if you do have to remove yourself from a dangerous situation.
Copyright is retained by the photographer unless the photographer was under an employment status of the hiring party or an agreement exists to transfer the rights. These rights exist even without registration, although that is recommended by the copyright holder.
The general rule in copyright law is that the author of the work is also the copyright owner. Photographers who are hired on an independent contractor basis or for a specific job are usually the copyright owner to the photographs, even if the photographs were taken for a client.
If a photographers work is not registered for copyright protection, then they cannot file a lawsuit against the person who infringed upon their work. Without copyright protection, photographers are unable to pursue legal action in the event that someone uses their work without permission.
