At least 10 years have passed since you were sentenced for your last conviction or since you were incarcerated (whichever is later.) Any time you spent on probation or parole counts towards these 10 years, but time you served in jail or prison does not.
If you have no more than two misdemeanor convictions or one felony and one misdemeanor conviction, you may be eligible to have those convictions sealed. You must apply to the court to have your records sealed.
The Clean Slate Act (CPL 160.57) will automatically seal an individuals New York State criminal records. The law takes effect on November 16, 2024.
The following entities will be able to see the sealed conviction/prosecution: Federal, state, and local law enforcement agencies acting within scope of their law enforcement duties; Courts in the unified court system; Probation departments; Sheriffs offices; District attorneys offices; The NY State

Under the Clean Slate Act, New Yorkers will be eligible to have conviction records automatically sealed 3 years from sentencing for misdemeanors and 8 years from sentencing for felonies, not including time incarcerated.
The long-debated controversial Clean Slate Act which will automatically seal most criminal records has passed both houses of the state Legislature. During a marathon session late Friday night, lawmakers voted to adopt the bill as they push through the weekend to wrap up their business for the year.
In New York, a misdemeanor conviction stays on your record forever. To have it removed, you must seek an expungement.
