How to Conduct a Trademark Search Open the USPTO Trademark Electronic Search System online. Select Word and/or Design Mark Search (Free Form). Try the obvious first. Make sure youre covering all the bases. Expand the field of search. Narrow the search to reduce distractions. Review the records you found.
Other trademark clearance search resources include state trademark registration databases, social media, and good old internet search engines. These are helpful because not every trademark is registered with the USPTO. Additionally, you can run a business name search, since not all businesses trademark their names.
To search the USPTOs trademark database, go to TESS. Choose a search option. If you are searching for a name, use the trademark name search. If you are searching for a design mark, such as a logo, you will first need to look up your design code using the USPTOs Design Search Code Manual.
For a more in-depth search, you may choose to use a trademark screening service or work with an experienced U.S.-licensed attorney. An attorney can provide a clearance search and interpret the search results as well as advise you on how to apply for federal trademark registration.
Petitions for cancellation of a trademark registration are governed by 15 U.S.C. Section 1064. There are several legal grounds that exist to cancel a trademark registration, including priority, abandonment (by non-use of at least three consecutive years together with an intent not to resume use), and fraud.
If your trademark has fallen into dead or abandoned status unintentionally, you may petition the USPTO within 60 days of the Notice of Abandonment. After the 60 days have lapsed, or if you cannot document the abandonment was unintentional, you will need to file a trademark application with the USPTO.
