Refile the trademark application In the event your trademark was abandoned you can always start the process over again by refiling the trademark. Refiling your trademark will require you to pay the processing fees again as if you are doing it for the first time.
A petition for cancellation of a trademark registration may be filed at any time. However, a mark which has been registered for more than five years may only be cancelled on the grounds enumerated in Trademark Act 14.
The first step in canceling a trademark is to file a petition for cancellation. In your petition for cancellation, you will need to show you have standing to cancel the trademark. You will also need to pay the registration fee. It can be done either on paper or electronically.
A trademark cancellation proceeding is exactly what it sounds like. Its a legal case, similar to a civil lawsuit (although it is by contrast processed in the Trademark Trial and Appeal Board (TTAB)), in which a complainant is provided with the opportunity to attack and ultimately cancel a defendants trademark rights.
You must tell the Intellectual Property Office ( IPO ) if any of the details held in the trade mark register need updating or correcting. You must also tell IPO if you want to give up your rights to your trade mark or appoint a representative or agent.
When a trademark is abandoned, the trademark owner may no longer claim rights to the trademark. In effect, this frees the trademark so that anyone else can use it without recourse from the original trademark owner.
The Loss of Trademark Rights A mark will be considered abandoned if you stop using it for three consecutive years and you have no intent to resume its use. You can also lose a mark through improper licensing or improper assignment.
When a trademark is abandoned, the trademark owner may no longer claim rights to the trademark. In effect, this frees the trademark so that anyone else can use it without recourse from the original trademark owner.
You may challenge a trademark registration issued by the USPTO by filing a petition to cancel the registration with the Trademark Trial Appeal Board (TTAB).
The proprietor can file an application under Section 58 of the Act to the Registrar of Trademarks (Registrar) for cancelling his trademark. The Registrar may on receipt of such application, cancel the entry of trademark from the register of trademarks.
