There are several legal grounds that exist to cancel a trademark registration, including priority, abandonment (by non-use of at least three consecutive years together with an intent not to resume use), and fraud. There are additional grounds as well, such as priority of use and genericness.
Hence, any company that uses or registers marks should document and save copies of materials proving the date of first use of any kind (e.g., press releases, advertising) for each of its marks and also the date of first sale of any goods or services sold in connection with the marks.
Use in commerce is demonstrated by means of a so-called specimen which is a real-world example of how a particular trademark is being used with goods or services. Alternatively, when the trademark is not yet being used with goods or services in commerce, the trademark application may be filed with an intent to use.
A date of first use anywhere is the date when (1) the goods were first sold or transported, or the services were first rendered, under the mark, and (2) such use was bona fide and in the ordinary course of trade.
To search the USPTOs trademark database, go to TESS and choose a search option. If you are searching for a name, you can use the trademark name search.
Once you own a trademark registration, you must do a few important things to maintain that registration and keep it alive. First, you must use your trademark in commerce. Additionally, you must file certain documents at regular intervals to show that youre continuing to use your trademark.
Q: What Invalidates a Trademark? A: The USPTO may invalidate a trademark if they determine it is too closely resembling another one and could cause confusion in customers. Trademarks must be distinct and create a different impression in customers than others.
What is proof of use? Photographs that show the mark on a tag or label affixed to the goods. Hangtags or labels with the mark and the generic name of the actual goods on the tag or label and informational matter that typically appears on a tag or label in use in commerce for these types of goods.
