In Oklahoma, swelling prison ranks are causing some inmates to languish in county jails for months, at times, before being transferred to state prisons to serve their sentences. The issue, described by prison officials as county jail backlog, cost the state Corrections Department roughly $20 million in 2012.
The 85% rule essentially prevents an inmate from being released from custody - by DOC through the application of credits or released on parole - prior to serving 85% of the sentence imposed. The sentences subject to this rule are those contained in statute.
Oklahoma County Jail can take up to 24 hours to release someone once their bond has been posted.
The 85% Rule For instance, if you are convicted of first degree manslaughter and receive a sentence of 10 years in prison, you will be required to serve 8.5 years before being eligible for early release. Crimes for which this 85% rule is applied include, but are not limited to, the following: First-degree murder.
The Oklahoma County Detention Center is one of the deadliest jails in the country. 14 people died at the jail in 2021. 16 died in 2022. Six have died so far this year.
