If you're a landlord in California looking to rent a property, understanding the lease agreement is essential. This tutorial, presented by Andrew Chung from DoorLoop, emphasizes the lease's importance in establishing your relationship with tenants. A well-structured lease agreement protects your interests and should outline key terms such as recurring fees, pet policies, and termination conditions. The lease functions as a contract between you and your tenants, detailing rules about rent payments, security deposits, and other critical aspects. This video aims to ensure that your rental process is smooth by highlighting what should be included in the lease agreement.

A lease obligates both you and your landlord for a set period of time, usually a year. Under a typical lease, a landlord cant raise the rent or change other terms, until the lease runs out (unless the lease itself provides for a change, such as a rent increase mid-lease).
For month-to-month tenancies, you must provide a 30-day written notice of the change in the terms of the tenancy. If the change involves a rent increase of more than 10%, a 90-day notice is required. However, if the increase is due to income or household size recertification, you only need to provide 30 days notice.
Security deposits are now capped at one months rent As of July 2024, security bonds will be capped at an amount equal to one months rent. Previous laws allowed up to three months rent to be collected in bond, on top of the standard first month paid before occupancy.
If either party wishes to make a change, they must first obtain the agreement of the other party. The landlord and tenant must also ensure that any changes to the agreement comply with the law. In addition, any changes to the tenancy agreement must be in writing and must be signed by both the landlord and the tenant.
The law allows the landlord to keep all or part of the tenants security deposit if the tenant has made an alteration to the unit not previously approved by the landlord or if the unit is not returned to its original state, ing to the California Tenants Guide.
For term tenants, a landlord can only change if the provision allowing the change is enforceable. If the lease doesnt authorize the change, the landlord can only make the change with the tenants consent or at the end of a fixed-term lease through a new lease or lease renewal.
But, your landlord can still require you to move out for one of the no-fault reasons listed in the law. If your landlord evicts you for one of these reasons, they must first give you one months rent or waive one months rent to help you move out.
