Is applicant same as assignee?

Assignee Filing The applicant is the person making the application and can be the inventors, the assignee, the obligated assignee, or a person who otherwise shows sufficient proprietary interest in the matter, as indicated in new 37 CFR 1.42.

What is the difference between applicant and assignee?

The applicant may either make the application in the Patent Office himself or jointly with any other person. The assignee of the inventor is the person with whom the inventor has entered into a contract and given that person all the rights to deal with the patent.

Who is the owner of a patent the inventor or applicant?

In the US, the inventor is presumed to be the initial owner of a patent or patent application. If there is more than one inventor, there may be more than one owner. Ownership can be transferred or reassigned.

What happens when you assign a patent?

Patent assignment transfers your ownership rights in your patent from yourself to your company. This means that once you assign the patent, you transfer all ownership and control of that patent and its intellectual property rights as the patent inventor to another entity/company, known as an assignee.

How do patent assignments work?

In a license agreement, the patent owner gives another entity (the licensee) permission to use the patented technology, while the patent owner retains ownership. In a patent assignment, the original owner permanently transfers its ownership to another entity.
