The legislation created a petition process for those convicted of some low-level offenses to have their criminal records expunged or erased, providing them with a clean slate. This process is available to individuals who have not committed an offense in the past 10 years and have not been convicted of serious crimes.
The filing fee for an expungement petition is $75. Other costs associated with this method of filing will include photocopying documents, mailing the documents using certified mail, and the purchase of stamps and envelopes. The total cost would be about $200.
To expunge is to erase or remove completely. In law, expungement is the process by which a record of criminal conviction is destroyed or sealed from state or federal record.
The Clean Slate Act (CPL 160.57) will automatically seal an individuals New York State criminal records. The law takes effect on November 16, 2024.
The waiting period for eligibility to expunge a record under the Clean Slate Law is 10 years from the last conviction, release from incarceration, or completion of probation whichever comes last. It is a step toward giving individuals with old convictions a fresh start.
You are applying to seal an ineligible offense, including a violent felony, Class A felony, homicide felony, sex offense, sexual performance by a child offense, or a felonious attempt or conspiracy to commit any of these ineligible offenses.
Under N.J.S.A. 2C:52-7, a person who has committed only one (or no) indictable offense during the course of his entire life will be eligible for an expungement. In other words, someone who was convicted of two or more indictable offenses cannot seek an expungement except under very specific conditions.
In New Jersey, if you only have one indictable offense conviction, the equivalent of a felony in other states, you can expunge the offense five years after completing your sentence and paying your fines. See N.J.S.A. 2C:52-2 (2019).
