The Berne Convention stipulates that the duration of the term for copyright protection is the life of the author plus at least 50 years after their death. For some categories of works, the minimum duration is shorter: for example, the minimum term for applied art is 25 years, movies have a minimum term of 50 years.
The law mandates that recordings published before 1923 expired on January 1, 2022; recordings published between 1923 and 1946 will be protected for 100 years after release; recordings published between 1947 and 1956 will be protected for 110 years; and the protection for all recordings published after 1956 that were

As a general rule, for works created after January 1, 1978, copyright protection lasts for the life of the author plus an additional 70 years.

All that is necessary is that the copying be substantial and material and that protected expression not just ideas were copied. Likewise, the similarity between the two works must be similarity of protected elements (the expression), not unprotected elements (the facts, ideas, etc.).
